Legal Assistance When Buying a Condominium

BSA Law offers condominium purchasers a comprehensive, flat-fee legal service package which includes the following:

  • review of title
  • review of purchase-sale agreement
  • advice on taxes, transfer fees, sinking fund, management fees and similar incidental costs arising from the transfer and ownership of a condominium unit
  • confirmation that unit qualifies for purchase by foreigner (if applicable)
  • assistance in obtaining necessary banking documentation for purchase
  • use of the BSA bank account for the remittance of foreign currency to be used in the purchase (if purchaser does not have their own account in Thailand)
  • coordination with seller, agents and seller’s bank (if applicable)
  • advice on method of payment to seller and other interested parties
  • representation of the purchaser at time of transfer at the Land Office (a BSA Law attorney will act on the buyer’s behalf under Power of Attorney so the buyer need not be present at the Land Office in person)
  • translation of the title deed and Land Office transfer agreement
  • transfer of water and utilities meters and accounts into the name of the condo purchaser
  • general consultation services

 Notes:

(1)        If BSA Law handles funds of the client, BSA Law acknowledges that unless the client has specified otherwise with regard to specific funds (i.e., legal fees and cost reimbursements designated as such by the client) these funds will remain the property of the client and BSA Law shall only act as custodian of those funds under Thai law.

 

(2)        The fees are intended to cover all services reasonably related to the purchase of the condominium unit.  However, the fees do not cover services related to claims for a refund or damages from the seller, developer or others in the event of breach or default by such party.  The fee for such services, if necessary, would be negotiated separately.
